These are the terms you agree to when you sign up to The Basin Gym (ABN 52 331 467 600 โ "Basin", "we", "our", "us"). They cover billing, how to pause or cancel, refunds, and the conduct we expect from every member. They sit alongside the BECS Direct Debit Service Agreement issued separately by Easy Debit and the Privacy Policy. If anything is unclear, text Nick on 0421 233 061 before signing up.
1. Membership + billing
- Membership is paid via direct debit through Easy Debit. The Direct Debit Service Agreement issued by Easy Debit when you sign up sets out the schedule, the amount, and how disputes are handled. That agreement governs the debit relationship between you and Easy Debit; these terms govern the membership relationship between you and Basin.
- Direct debits run on the schedule shown to you at sign-up (typically weekly or fortnightly). Failed debits are retried per Easy Debit's policy; we may apply a dishonour fee passed through from the bank.
- Membership pricing is the rate quoted to you at sign-up and printed on your Membership Agreement. We will give you at least 30 days' notice by email or SMS before any change to your ongoing rate. You may cancel without penalty before the new rate starts.
- Joining fees (where applicable) are non-refundable except where required by the Australian Consumer Law.
2. Cooling-off period
If you sign up online or off-premises (i.e. not in the gym), you have 7 days to cancel without giving a reason and without penalty under NSW Fair Trading rules. To cool off, email thebasingym@gmail.com within 7 days of signing up. Any debits taken during this period will be refunded.
3. Pause / hold
- You can pause your membership for up to 12 weeks per calendar year in blocks of at least 1 week. Pauses freeze direct debits for the duration.
- Reasonable grounds: travel, injury, medical, work commitments, or any other genuine reason. We don't require evidence for stays under 4 weeks.
- Email thebasingym@gmail.com with your start and end date. We'll confirm within one business day. Pauses applied retroactively are at our discretion.
4. Cancellation
In line with ACCC guidance, cancelling is no harder than signing up. Two paths:
- Direct with us: email thebasingym@gmail.com with the subject "Cancel my membership". We require 14 days' notice from the date of your email; one final debit may be taken in that window covering training through the notice period. After the notice period, debits stop and your portal access is closed.
- Via your bank or Easy Debit:you can cancel the direct-debit authority at any time by contacting your bank or Easy Debit. This stops the debits but doesn't formally end the membership with us โ please email us as well so we can close your access and stop reminders.
There is no cancellation fee. Pre-paid memberships (where you've paid for a fixed period in one go) are non-refundable for the unused balance unless required by the Australian Consumer Law.
5. Health screening + your responsibilities
- You must complete the Pre-Activity Readiness Questionnaire (PAR-Q) before training. Tell us about any new injury, surgery, pregnancy or medical change as soon as it happens.
- You agree to use the equipment safely, follow staff instructions, and not train while affected by alcohol or drugs.
- Lockers and personal items are at your own risk โ Basin is not liable for theft or loss.
- You will respect other members and staff. We may suspend or terminate any membership for harassment, threatening behaviour, repeated rule-breaking, or damage to the facility โ without refund of paid-but-unused fees beyond what the ACL requires.
6. 24/7 access (when applicable)
Members with after-hours access agree to a separate signed waiver covering unsupervised training, emergency procedures, and accompanied-guest rules. Access tags or fobs remain Basin property and must be returned on cancellation. Sharing access with non-members is grounds for immediate termination.
7. Liability
Nothing in these terms excludes any consumer guarantee under the Australian Consumer Law that cannot be excluded.
To the extent permitted by law, Basin's liability for any claim arising out of your membership is limited to either: (a) re-supplying the relevant service; or (b) refunding the amount you paid for that service. Training is inherently physical and you accept the ordinary risks of strength + conditioning training.
8. Changes to these terms
We may update these terms โ for clarity, to reflect a regulatory change, or to cover a new service. Material changes will be emailed to you at least 30 days before they take effect. Continuing your membership after the effective date constitutes acceptance.
